Experienced SafeSport Attorney
SafeSport litigation is a relatively new area of law. The United States Center for SafeSport was established in 2017 and is tasked with reviewing allegations of misconduct from persons involved in Olympic sports. If you have been named in a SafeSport complaint, a SafeSport attorney at Jenkins Fenstermaker, PLLC can help you navigate the complaint process and provide an effective defense.
A Knowledgeable SafeSport Attorney is Critical to a Successful Defense
Representation in a SafeSport investigation is different from representation in any other criminal or civil case. SafeSport is an independent body and has its own mechanisms for investigation, negotiation, and prosecution. Having a knowledgeable SafeSport complaint advisor and attorney by your side is critical to a successful defense.
When You Should Call a SafeSport Attorney
When SafeSport begins a formal investigation, the Center will send a notice of allegations letter to the accused. The notice will include a description of the alleged misconduct, the date or timeframe during which the incident allegedly occurred, and the parties involved. If you receive a notice of allegations letter, you should immediately contact a SafeSport lawyer. A SafeSport complaint lawyer will be able to help you navigate every step of the investigation and potential arbitration. The sooner you contact an attorney, the better you will be prepared to navigate the rest of the investigative process.
What to Expect Following a SafeSport Complaint
The SafeSport Code for the US Olympic and Paralympic Movement sets forth the procedures for investigating claims of misconduct. When the Center receives a complaint, it will start proceedings with a preliminary inquiry to determine whether the complaint warrants a full investigation. If you are named in a complaint and the complaint does not move forward with a formal investigation, you may not ever be notified about the complaint.
If the Center determines that there was a violation of the Code and there is sufficient evidence to investigate, they will move forward to a full investigation, at which point you will be notified that you were named. A full investigation includes interviewing parties and reviewing evidence. At any point in the investigative process, the Center can reach an “informal resolution” which is an immediate and final resolution of the matter.
After an investigation is complete, the director of the investigation issues a ruling which determines whether the accused party has violated the Code and what sanctions will be imposed. After a decision is rendered, each side has a right to request an arbitration hearing. At the hearing, an arbitrator will hear both sides, review the evidence, and issue a final decision.
A SafeSport Complaint Lawyer Can Represent Your Interests
A SafeSport lawyer is critical to protecting your rights when you are named in a SafeSport complaint. An attorney with experience will ensure your rights to due process and a complete investigation. Your SafeSport lawyer will also enforce the required procedural rules of the Center’s Code, help you prepare for your interview, gather exculpatory evidence, and handle your appeal in JAMS arbitration.
If you have questions along the way, your attorney can communicate with the SafeSport complaint advisor to gather information throughout the process. Having a skilled attorney by your side gives you the best chance of a fair process and walking away with a favorable outcome.
