Gould Elected to Jenkins Fenstermaker Management Committee

Huntington, WV – Jenkins Fenstermaker, PLLC recently announced the election of Charles K. Gould, member, to the firm’s Management Committee where he will be responsible for drafting and implementing firm management policies.  Gould replaces Robert H. “Bo” Sweeney, Jr., who returns to full-time practice in asbestos, mass tort and construction litigation.

Mr. Gould was hired as an associate by Jenkins Fenstermaker in 1997 and elected to membership in 2006. His practice areas include domestic relations and general civil litigation.  He earned his bachelor’s degree from Ohio University and his juris doctorate from Case Western Reserve University.    

Mr. Gould was admitted to the Ohio State Bar in 1996 and the West Virginia State Bar in 1997.  He is also a member of the Supreme Court of Appeals of West Virginia; the Supreme Court of Ohio; and the United States District Court, Southern District of West Virginia.

Gould began his three-year term on the management committee in January.

Jenkins Fenstermaker Pledges $25,000 to Cabell Huntington Hospital Children’s Hospital Project

Huntington, WV – Jenkins Fenstermaker, PLLC, recently pledged $25,000 to the proposed Children’s Hospital project at Cabell Huntington Hospital.

This generous pledge has been recognized by dedicating a GE Healthcare OmniBed® in the hospital’s Neonatal Intensive Care Unit (NICU) for seriously ill newborns. The new NICU opened in February 2008 and is the first phase of the proposed Children’s Hospital.

“Jenkins Fenstermaker chose to make this pledge to improve our regional community and the lives of many children into the future,” said Jenkins Fenstermaker CEO, Barry Taylor.  “The Children’s Hospital at Cabell Huntington Hospital is a tremendously exciting project that we fully support.  Each of our Members deeply believe that this pledge is an investment into not just a building, but the health of our extremely vulnerable children.”

The proposed Children's Hospital will include a new entrance specifically for young patients and a complete renovation of the fifth floor Pediatrics Unit and the Pediatric Intensive Care Unit.

“We are grateful for Jenkins Fenstermaker’s commitment to improving the care we provide for our youngest patients,” said David Graley, vice president and chief operating officer of the Cabell Huntington Hospital Foundation. “The Members of the firm took the time to understand our mission and quality of care of the region’s children. The first phase of the new Children's Hospital opened in February 2008 with the unveiling of the 36-bed Neonatal Intensive Care Unit on the fifth floor of the North Patient Tower. The Cabell Huntington Hospital Foundation is raising $12 million for the estimated $15 million project through the end of 2011.

Huntington, W.Va. – Rachel Perdue Turner, a native of Huntington, is the most recent attorney to join Jenkins Fenstermaker, PLLC.

Turner graduated summa cum laude from Washington & Lee University in 2001, where she earned a Bachelor of Science degree in Accounting. As an undergraduate, Turner was a member of Phi Beta Kappa, Phi Eta Sigma and Beta Gamma Sigma national honoraries. In 2004, she obtained her law degree from Washington & Lee University School of Law, where she graduated magna cum laude. While there, Turner won such honors as the Roy L. Steinheimer, Jr. Commercial Law Award.

Turner is admitted to the West Virginia and New York State Bars. She is also admitted to the United States District Courts for the Southern Districts of West Virginia and New York. She is a member of the American Bar Association, West Virginia State Bar Association and New York State Bar Association. Turner’s practice will focus primarily on general litigation. MICHAEL ESTEP ANNOUNCED AS MEMBER

Huntington, W.Va. – The law firm of Jenkins Fenstermaker, PLLC is pleased to announce that Michael Estep has been named a member and owner of the firm effective Jan. 1, 2008.

Estep, a West Virginia native, has been an associate with Jenkins Fenstermaker for seven and a half years. His work ethics as an attorney and dedication to Jenkins Fenstermaker’s clients have made him a valuable asset to the firm.

Estep specializes in labor and employment law and employment litigation. Most recently, he represented Cabell Huntington Hospital in the contract negotiations with the Service Employees International Union. Estep represents clients in employment-related matters in state and federal court and before various administrative agencies, including the National Labor Relations Board, the Equal Employment Opportunity Commission, the West Virginia Human Rights Commission, the Occupational Safety and Health Administration, and the West Virginia Workers’ Compensation Office of Judges and Board of Review. 

Tom Krieger, chairman of the firm’s labor and employment practice group for the past 30 years, had this to say:

Estep was born in Charleston, W.Va. He majored in accounting at Marshall University and graduated in 1997 with a bachelor’s degree in business administration. Estep earned his law degree from the West Virginia University College of Law in 2000. He was admitted to the West Virginia State Bar and the United States District Court for the Southern District of West Virginia in 2000 and the United States Court of Appeals, Fourth Circuit, in 2003.

Estep and his wife Elizabeth, a Huntington native, have a 3-year-old son named James Michael. Estep said he made the decision to practice law in his home state when he married Elizabeth in 2000. The Esteps attend Fifth Avenue Baptist Church in Huntington.

During his time in Huntington, Estep volunteered in various capacities for the United Way of the River Cities. He is a member of the American Bar Association, West Virginia Bar Association, Cabell County Bar Association and the Tri-State Society of Human Resource Management.

BARRY TAYLOR REELECTED AS CEO

Huntington, W.Va. – Barry Taylor has been reelected as CEO of the Huntington law firm Jenkins Fenstermaker, PLLC effective Jan. 1.  Taylor first was elected in 2005 to a three-year term as Chief Executive, and he recently was reelected to serve as CEO for another three years.

As the Chief Executive Officer of Jenkins Fenstermaker, Taylor will implement the policies and decisions of the firm’s members and management committee and will be responsible for overseeing ad hoc committees.

Taylor earned his law degree from the Marshall-Wythe School of Law at the College of William and Mary in Williamsburg, Va. He specializes in medical malpractice defense for physicians and hospitals and insurance defense and litigation.

Taylor has been an attorney with Jenkins Fenstermaker for 23 years and presently is chairing the Huntington Regional Chamber of Commerce.  He also is a member of Central Christian Church in Huntington, where he has served as an elder since 1998 and the chair of the church’s trustees since 1993.

Attorneys Educate Architects, Engineers and Attorneys in our Region

Huntington, W.Va. - Robert H. Sweeney, Jr., and Gary A. Matthews, attorneys with the Huntington law firm Jenkins Fenstermaker PLLC recently conducted a seminar in Charleston on the American Institute of Architects Standard Form Construction Contracts.  The seminar provided continuing education credits for the architects, engineers and attorneys who attended.  The presentations focused on the key elements of standard form contracts, which are the most heavily used form contracts in the construction industry.  Highlights of the seminar included a detailed analysis of the general conditions of the contracts, alternatives to the contracts and changes implemented in the newly adopted 2007 versions of the agreements.

Thomas E. Scarr, also an attorney with Jenkins Fenstermaker PLLC, and Linda Persun of Alcon Manufacturing Ltd. presented a lecture titled “HR Essentials 101: The Interviewing, Hiring, On-Boarding & Performance Evaluation Processes” at the 2007 Human Resources Summit & Governor’s Safety Conference in Charleston.  This seminar, sponsored in part by Jenkins Fenstermaker PLLC, focused on the human resources issues commonly faced by employers.

Huntington, WV –Jenkins Fenstermaker’s Lee Murray Hall was recently installed as secretary to the Defense Trial Counsel of West Virginia for the 2007 to 2008 term. According to Defense Trial Counsel by-laws, she will move from secretary to treasurer to vice-president and finally to president in 2010 to 2011.

The Defense Trial Counsel of West Virginia was formed in 1981 to provide a cohesive network of West Virginia attorneys who defend individuals and corporations in civil litigation. It has a membership of approximately 400 attorneys, dedicated to the defense of these clients. Membership in the association is restricted to attorneys licensed in the state of West Virginia who devote the majority of their practice to representing defendants in civil litigation of various types.

Ms. Hall has also served on the Board of Governors for the organization from 2004 to 2005 and has served as chair of the Insurance Substantive Committee from 2004 to 2006.

Her practice includes general civil litigation, with an emphasis on insurance coverage and bad faith, general liability claims and commercial liability disputes. She has served as arbitrator for coverage disputes on professional liability policies in Kentucky and West Virginia and has been named to the Best Lawyers in America, Insurance Law, 13th Edition, 2007, and named a West Virginia Super Lawyer 2007 by Law & Politics magazine.

Jenkins Fenstermaker’s Mary Costa Celebrates 30 Years

Huntington, WV – Huntington law firm Jenkins Fenstermaker, PLLC, hosted a unique party this month, celebrating 30 years of service by receptionist and life-long Huntington resident Mary Costa.

In an age when employees tend to hop from job to job in hopes of securing higher pay and climbing corporate ladders, Ms. Costa knew from the start that Jenkins Fenstermaker was the place for her.

“I came to work at 8:30 that first morning and by 5 o’clock, I knew I was right where I wanted to be,” she said.

She still remembers interviewing with Norman Fenstermaker during a time when secretarial candidates still took typing tests. “I was nervous of course, but I fell in love with Mr. Fenstermaker,” she said. “I just think the world of him. They broke the mold when both Norman and Jack Jenkins were made.”

Ms. Costa began her career at Jenkins Fenstermaker as a receptionist. “In the beginning, we were very small. There were five attorneys here,” she recalls. “I did the posting of all their daily time entries by hand while answering the phones.” She also recalls making long distance phone calls, at a time when the operator would call back with time and charges for each call.

After Glenna Smoot, secretary to Norman Fenstermaker, retired from her position after 30 years, Ms. Costa assumed many of her responsibilities, but eventually found her way back to the reception desk.

At her surprise party this month, employees of Jenkins Fenstermaker showered her with gifts, including a double strand of pearls she describes as “absolutely beautiful.”

Ms. Costa says she’s seen a lot in her 30 years with the firm. One trend she sees in business today that disturbs her is seeing how employees, particularly the younger ones, use each job as a stepping stone to the next.

“To me, there are no roots being planted,” she says. “If you know you’re going to leave, how can you have a root grow? I’ve experienced all of that and they’re missing out on so much.”

Ms. Costa has had her share of opportunity, but says, “I’m a firm believer that the grass is never greener on the other side.” Although she admits it hasn’t always been a bed of roses, she’s always felt it a privilege to work for Jenkins Fenstermaker.

“Our clients repeatedly tell us that we have an outstanding receptionist and we know Mary is a real asset for us,” said Barry Taylor, CEO.  “We are in an era when callers often are greeted by a computer, and Mary is so much more. 

She is professional, caring, and long has understood the importance of her position to our success.”

The day the firm threw the party for her, Ms. Costa told them they had her for 10 more years. The only thing she wants then is her name on the letterhead.

“I don’t think Mr. Fenstermaker would mind. We can just call it Jenkins Costa.”

Jenkins Fenstermaker Sponsors Well Attended After Hours Event

Huntington, WV – Huntington law firm Jenkins Fenstermaker, PLLC, sponsored the Putnam County Chamber of Commerce’s monthly networking event, “Business After Hours,” last week at the Sleepy Hollow Golf Club in Hurricane, W. Va. The event marked one of the most heavily attended in recent years, with approximately 90 chamber members and guests present.

Cabell County Extension Agent and WSAZ’s Lawn and Garden expert John Marra, was the guest speaker and captured the audience’s interest with a timely and vivacious presentation about spring plantings and bird life. The event provided an excellent opportunity for attendees to mingle, network and spend time with other business leaders in a social setting.

Scarr served the DTCWV previously as vice president, secretary, treasurer and as a board member.

Scarr received his juris doctorate at the Marshall-Wythe School of Law of the College of William and Mary in Williamsburg, Virginia. He currently serves on several boards, some of which include the Huntington Museum of Art, the Huntington Jewish Benevolent Association, the Huntington Regional Chamber of Commerce and the Boy Scouts of America, Tri-State Area Council Executive Board.

The DRI award is one of several that Scarr has been honored with during his career. He will be recognized at the DRI Annual Meeting in Chicago this October.

Jenkins Fenstermaker Successfully Defends Five Cases

Huntington, WV –  Huntington law firm Jenkins Fenstermaker, PLLC, (JF) successfully prevailed in five separate trials so far this year.

In the first case, JF defended SNE Enterprises, Inc., a window manufacturing company, and its former human resources officer in a handicap and disability discrimination action, in the Circuit Court of Cabell County, West Virginia. JF attorneys, Thomas Scarr and Steven Wellman asserted for the defendant that the claimant, an SNE employee who suffered a shoulder injury, was not called back to work following a seasonal layoff due to lack of available light duty work and the claimant’s inability to perform essential functions of any regular line job. The plaintiff claimed that SNE failed to make reasonable accommodations so that the employee could return to work.

In a second case, attorney Scarr successfully defended Central West Virginia Regional Airport Authority (Yeager Airport) in a premises liability action in the Circuit Court of Kanawha County, West Virginia. The plaintiff claimed she was injured when she slipped and fell on stairs while exiting Yeager Airport Terminal to board an Atlantic Coast Airlines flight. A jury found that although the Airport Authority exercised control over the premises on which the plaintiff fell, the condition that may have existed was not affirmatively caused by any negligent act of the Airport Authority. Judge Irene C. Berger entered judgment on a defense verdict after a three day trial.    

Attorney Scarr and fellow JF attorney Charles Gould, representing defendant property owners, opposed another effort in the Circuit Court of Cabell County, West Virginia, to invalidate a covenant in a 103-year-old deed limiting property owners to the erection and use of buildings for residential purposes. The plaintiff sought to invalidate the restrictive covenant so that it could demolish certain existing homes and develop a retail drug store in the residential neighborhood.   Judge John L. Cummings found the plaintiff’s proposed use of the property was in violation of the restrictions. He also found that changes in conditions either within or outside the covenant area were not so radical as to destroy the intent and purpose of the restrictive covenant, and that the defendants had not otherwise abandoned or waived their rights to enforce the covenant. 

In a fourth case, JF attorneys Barry Taylor and Max Corley, III, defended a Huntington cardiothoracic surgeon in a medical malpractice suit in the Circuit Court of Cabell County, West Virginia. The claim related to a nerve injury which occurred during the surgical removal of a carotid artery blockage in 2001.

Complications occurred which arguably resulted in difficulties related to speech, swallowing and oral function. A defense verdict was entered after a four day trial. No appeal is being pursued.

And in a fifth case, Taylor and JF attorney Brian Lindsay successfully defended a former Huntington obstetrician/gynecologist in a medical malpractice suit in the Circuit Court of Cabell County, West Virginia. The physician performed a hysterectomy in 2000 for a post-menopausal patient with an enlarged fibroid uterus. Complications occurred which arguably contributed to the surgical removal of a kidney in 2002. Judge John L. Cummings entered judgment on a defense verdict following a three day trial.  Again, no appeal is being pursued.

Barry Taylor Named CEO of Jenkins Fenstermaker

Huntington, WV –  Barry Taylor, a practicing attorney with the law firm Jenkins Fenstermaker, PLLC, recently was elected CEO of the firm. In his capacity of CEO, Taylor will serve three years as chief executive of the firm, implementing policies and decisions of  the members and the management committee, and overseeing ad hoc committees.

Taylor earned his law degree from the Marshall-Wythe School of Law of the College of William and Mary in Williamsburg, Virginia. He concentrates on medical malpractice defense for physicians and hospitals, automobile warranty, insurance defense and mass tort litigation.

In addition to Taylor’s appointment, William McGee and Stephen Golder were elected to serve on the management committee of the firm. They will be responsible for overseeing firm policy issues. 

Golder, who will serve a one-year term on the management committee, received his law degree from the University of Virginia School of Law and specializes in commercial and business law, commercial real estate development, mergers and acquisitions, and bankruptcy law.

McGee, who is serving two-years on the management committee, earned  his law degree from the University of Cincinnati and specializes in business law, probate and trust law, estate planning, ERISA and employee benefits.
