Huntington, WV Jenkins Fenstermaker’s Lee Murray Hall was recently installed as secretary to the Defense Trial Counsel of West Virginia for the 2007 to 2008 term. According to Defense Trial Counsel by-laws, she will move from secretary to treasurer to vice-president and finally to president in 2010 to 2011. The Defense Trial Counsel of West Virginia was formed in 1981 to provide a cohesive network of West Virginia attorneys who defend individuals and corporations in civil litigation. It has a membership of approximately 400 attorneys, dedicated to the defense of these clients. Membership in the association is restricted to attorneys licensed in the state of West Virginia who devote the majority of their practice to representing defendants in civil litigation of various types. Huntington, WV Huntington law firm Jenkins Fenstermaker, PLLC, hosted a unique party this month, celebrating 30 years of service by receptionist and life-long Huntington resident Mary Costa.
In an age when employees tend to hop from job to job in hopes of securing higher pay and climbing corporate ladders, Ms. Costa knew from the start that Jenkins Fenstermaker was the place for her.
“I came to work at 8:30 that first morning and by 5 o’clock, I knew I was right where I wanted to be,” she said.
She still remembers interviewing with Norman Fenstermaker during a time when secretarial candidates still took typing tests. “I was nervous of course, but I fell in love with Mr. Fenstermaker,” she said. “I just think the world of him. They broke the mold when both Norman and Jack Jenkins were made.”
Ms. Costa began her career at Jenkins Fenstermaker as a receptionist. “In the beginning, we were very small. There were five attorneys here,” she recalls. “I did the posting of all their daily time entries by hand while answering the phones.” She also recalls making long distance phone calls, at a time when the operator would call back with time and charges for each call.
After Glenna Smoot, secretary to Norman Fenstermaker, retired from her position after 30 years, Ms. Costa assumed many of her responsibilities, but eventually found her way back to the reception desk.
At her surprise party this month, employees of Jenkins Fenstermaker showered her with gifts, including a double strand of pearls she describes as “absolutely beautiful.”
Ms. Costa says she’s seen a lot in her 30 years with the firm. One trend she sees in business today that disturbs her is seeing how employees, particularly the younger ones, use each job as a stepping stone to the next.
“To me, there are no roots being planted,” she says. “If you know you’re going to leave, how can you have a root grow? I’ve experienced all of that and they’re missing out on so much.”
Ms. Costa has had her share of opportunity, but says, “I’m a firm believer that the grass is never greener on the other side.” Although she admits it hasn’t always been a bed of roses, she’s always felt it a privilege to work for Jenkins Fenstermaker.
“Our clients repeatedly tell us that we have an outstanding receptionist and we know Mary is a real asset for us,” said Barry Taylor, CEO. “We are in an era when callers often are greeted by a computer, and Mary is so much more.
She is professional, caring, and long has understood the importance of her position to our success.”
The day the firm threw the party for her, Ms. Costa told them they had her for 10 more years. The only thing she wants then is her name on the letterhead.
“I don’t think Mr. Fenstermaker would mind. We can just call it Jenkins Costa.”

Jenkins is a 2002 recipient of the Justicia Officium Award, the highest honor bestowed by the West Virginia University College of Law, recognizing outstanding contribution and service to the profession.
Krieger emphasizes labor and employment law. He graduated from West Virginia University and is a past president of Big Brothers Big Sisters of the Tri-State, and a former board member of the Cammack Children’s Center and Guyan Country Club. He also has been a member of the Huntington Forward Committee and has served on the Personnel and Finance Committees of the Fifth Avenue Baptist Church. Krieger has been recognized in several past editions of The Best Lawyers of America and has also been recognized as an America’s Leading Business Lawyer in the Top Tiers of West Virginia Employment - Lawyers by Chambers USA.
Scarr received his juris doctorate at the Marshall-Wythe School of Law of the College of William and Mary in Williamsburg, Virginia, and concentrates on general litigation, and labor and employment law. He currently serves on several boards, some of which include the Huntington Museum of Art, the Huntington Jewish Benevolent Association, the Huntington Regional Chamber of Commerce and the Boy Scouts of America, Tri-State Area Council Executive Board. Jenkins Fenstermaker Attorney Receives Award of Distinction
Huntington, WV Jenkins Fenstermaker, PLLC, (JF) announced today the recognition of Attorney Thomas Scarr, by the Defense Research Institute (DRI), a national organization of defense trail lawyers and corporate counsel.
Scarr recently completed a one-year term as president of the Defense Trial Counsel of West Virginia, a group of more than 400 West Virginia lawyers and 50 legal assistants that devote the majority of their legal practice to the representation of defendants in civil litigation. At his last meeting as president, Scarr was presented with the DRI Exceptional Performance Citation “for having supported and improved the standards and education of the defense bar, and for having contributed to the improvement of the administration of justice in the public interest.” Only a handful of attorneys are recognized with this prestigious award throughout the country each year.
Scarr served the DTCWV previously as vice president, secretary, treasurer and as a board member.

Jenkins Fenstermaker Successfully Defends Five Cases
Huntington, WV Huntington law firm Jenkins Fenstermaker, PLLC, (JF) successfully prevailed in five separate trials so far this year.
In the first case, JF defended SNE Enterprises, Inc., a window manufacturing company, and its former human resources officer in a handicap and disability discrimination action, in the Circuit Court of Cabell County, West Virginia. JF attorneys, Thomas Scarr and Steven Wellman asserted for the defendant that the claimant, an SNE employee who suffered a shoulder injury, was not called back to work following a seasonal layoff due to lack of available light duty work and the claimant’s inability to perform essential functions of any regular line job. The plaintiff claimed that SNE failed to make reasonable accommodations so that the employee could return to work.
In a second case, attorney Scarr successfully defended Central West Virginia Regional Airport Authority (Yeager Airport) in a premises liability action in the Circuit Court of Kanawha County, West Virginia. The plaintiff claimed she was injured when she slipped and fell on stairs while exiting Yeager Airport Terminal to board an Atlantic Coast Airlines flight. A jury found that although the Airport Authority exercised control over the premises on which the plaintiff fell, the condition that may have existed was not affirmatively caused by any negligent act of the Airport Authority. Judge Irene C. Berger entered judgment on a defense verdict after a three day trial.
Attorney Scarr and fellow JF attorney Charles Gould, representing defendant property owners, opposed another effort in the Circuit Court of Cabell County, West Virginia, to invalidate a covenant in a 103-year-old deed limiting property owners to the erection and use of buildings for residential purposes. The plaintiff sought to invalidate the restrictive covenant so that it could demolish certain existing homes and develop a retail drug store in the residential neighborhood. Judge John L. Cummings found the plaintiff’s proposed use of the property was in violation of the restrictions. He also found that changes in conditions either within or outside the covenant area were not so radical as to destroy the intent and purpose of the restrictive covenant, and that the defendants had not otherwise abandoned or waived their rights to enforce the covenant.
In a fourth case, JF attorneys Barry Taylor and Max Corley, III, defended a Huntington cardiothoracic surgeon in a medical malpractice suit in the Circuit Court of Cabell County, West Virginia. The claim related to a nerve injury which occurred during the surgical removal of a carotid artery blockage in 2001.
Complications occurred which arguably resulted in difficulties related to speech, swallowing and oral function. A defense verdict was entered after a four day trial. No appeal is being pursued.
And in a fifth case, Taylor and JF attorney Brian Lindsay successfully defended a former Huntington obstetrician/gynecologist in a medical malpractice suit in the Circuit Court of Cabell County, West Virginia. The physician performed a hysterectomy in 2000 for a post-menopausal patient with an enlarged fibroid uterus. Complications occurred which arguably contributed to the surgical removal of a kidney in 2002. Judge John L. Cummings entered judgment on a defense verdict following a three day trial. Again, no appeal is being pursued.

Huntington, WV Barry Taylor, a practicing attorney with the law firm Jenkins Fenstermaker, PLLC, recently was elected CEO of the firm. In his capacity of CEO, Taylor will serve three years as chief executive of the firm, implementing policies and decisions of the members and the management committee, and overseeing ad hoc committees.
Taylor earned his law degree from the Marshall-Wythe School of Law of the College of William and Mary in Williamsburg, Virginia. He concentrates on medical malpractice defense for physicians and hospitals, automobile warranty, insurance defense and mass tort litigation.
In addition to Taylor’s appointment, William McGee and Stephen Golder were elected to serve on the management committee of the firm. They will be responsible for overseeing firm policy issues.
Golder, who will serve a one-year term on the management committee, received his law degree from the University of Virginia School of Law and specializes in commercial and business law, commercial real estate development, mergers and acquisitions, and bankruptcy law.
McGee, who is serving two-years on the management committee, earned his law degree from the University of Cincinnati and specializes in business law, probate and trust law, estate planning, ERISA and employee benefits.
