LITIGATION

Our litigators are regularly engaged in litigation before state and federal courts in West Virginia, Kentucky and Ohio. For many of our corporate clients, we serve as corporate counsel and trial counsel. Our litigation practice areas include:

BUSINESS LITIGATION

Our attorneys have experience handling various types of business and commercial litigation, including contracts and Uniform Commercial Code litigation, anti-trust litigation, embezzlement and corporate malfeasance, real estate, creditors' rights, bankruptcy and tax litigation, and general business disputes. Our litigators recognize the importance of fully understanding our clients’ business objectives and are prepared to take an aggressive approach when business litigation is necessary.

PERSONAL INJURY, PRODUCTS LIABILITY AND TOXIC TORT

We handle all types of personal injury, products liability and toxic tort defense including trials, counseling and loss prevention programs. We represent local, regional and national businesses, and domestic and foreign product manufacturers, distributors, and retailers of automotive, construction, consumer products, pharmaceutical products, mining equipment, medical devices and toxic substances.

INSURANCE DEFENSE AND COVERAGE ANALYSIS

Insurance defense and coverage analysis has been a core practice group since the Firm was founded. Strong research, writing and communication skills, competitive rates and open working relationships with adjusters and insureds have been our hallmarks. It's enabled us to successfully represent clients in cases involving personal injury, products liability, toxic tort, property damage, construction claims, and “bad faith” claims, which have been on the rise in recent years in West Virginia.

HEALTH CARE

The Firm provides litigation and counseling services to the health care industry, including hospitals, physicians and other health care providers. In addition to defending professional liability litigation including malpractice, we also handle medical licensure and credentialing issues.

ARBITRATION AND MEDIATION

We recognize the advantages of alternative dispute resolution such as arbitration and mediation. Considering the sometimes lengthy delays in state and federal litigation cases, arbitration and mediation often save our clients time and money. We always assess the potential for arbitration and other alternative dispute resolution options as part of our initial case evaluation.
