YOU SHOULD NOW BE USING THE NEW I-9 FORM

Starting on January 22nd, employers were required to start using a new I-9 form. This is the form that employers must complete in order to verify the identity and work eligibility of employees. Employers who fail to use the new form "may be subject to all applicable penalties," according to the U.S. Immigration and Customs Enforcement agency ("ICE").

Given the Trump administration's focus on illegal immigration, more employers may be subject to those penalties. ICE reportedly conducts more than 3,000 I-9 employer audits each year. Commentators expect that number to rise in the coming years.

It is easy to obtain a copy of the new I-9 form. Just visit ICE's website at https://www.uscis.gov/i-9

Employers should remember to keep completed I-9 forms for each employee until one year after the employee is terminated, or three years after the employee was hired, whichever date is later.
